Terms of Service

1. Acceptance of Terms

By accessing or using the UShare platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform. UShare reserves the right to modify these Terms at any time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years of age and a resident of Canada to use UShare. By registering, you represent that the information you provide is accurate and that you have the legal capacity to enter into binding agreements.

3. Platform Role

UShare is a marketplace that connects item owners ("Owners") with renters ("Renters"). UShare is not a party to the rental transaction and does not own, inspect, or guarantee any listed items. All rental agreements are between the Owner and the Renter.

4. Rental Agreement & Waiver

4.1 Care of Item

The Renter agrees to use the rented item responsibly and in accordance with its intended purpose. The item must be kept in a secure location when not in use and must not be sub-rented or lent to a third party without express permission from the Owner.

4.2 Return Condition

The item must be returned in the same condition in which it was received, accounting for normal wear and tear. It should be cleaned and, if applicable, fully charged or fueled before return.

4.3 Damage & Loss

The Renter assumes financial responsibility for any damage to or loss of the item beyond normal wear and tear. Costs may be deducted from the security deposit, and any excess will be billed separately. "Damage" includes physical breakage, water damage, theft, and loss of accessories.

4.4 Late Returns

If the item is not returned by the agreed-upon date and time, a late fee equal to 1.5× the daily rate may be charged for each additional day. Extended absences beyond 48 hours without communication may be treated as loss and reported accordingly.

4.5 Assumption of Risk

The Renter acknowledges that the use of rented items carries inherent risks, including but not limited to personal injury and property damage. The Renter assumes all such risks and agrees that UShare and the Owner shall not be liable for any injuries or damages arising from the Renter's use of the item, except where caused by the Owner's gross negligence or willful misconduct.

5. Fees & Payments

UShare charges a service fee on each transaction: 15% from the Renter and 5% from the Owner. All payments are processed through Stripe. Refund eligibility is determined by the cancellation policy selected by the Owner at the time of listing.

6. Security Deposits

Owners may require a security deposit. Deposits are held by UShare and released to the Renter within 48 hours of a successful return, unless a damage claim is filed. If a damage claim is filed, the deposit (or a portion of it) may be released to the Owner following dispute resolution.

7. Optional Damage Protection

Renters may opt into UShare's optional damage protection plan at the time of booking. This plan covers accidental damage up to the item's listed value (subject to a deductible). Intentional damage, theft, and loss are not covered. Full plan terms are displayed at checkout.

8. Dispute Resolution

Any disputes arising from a rental transaction will first be handled through UShare's internal dispute resolution process. Both parties agree to participate in good faith. If the dispute cannot be resolved internally, the parties agree to pursue mediation in British Columbia, Canada before initiating legal proceedings.

9. User Conduct

Users must not list prohibited items (weapons, controlled substances, stolen property), misrepresent item condition, harass other users, or use the Platform for any illegal purpose. UShare reserves the right to suspend or terminate accounts that violate these guidelines.

10. Limitation of Liability

To the fullest extent permitted by law, UShare's total liability for any claim arising from your use of the Platform shall not exceed the fees paid by you to UShare in the 12 months preceding the claim. UShare is not liable for indirect, incidental, consequential, or punitive damages.

11. Privacy

Your use of UShare is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described therein.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any legal proceedings shall be brought exclusively in the courts of British Columbia.
